Profiling is any form of automated processing of personal data consisting of using that personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.
f) Pseudonymization
Pseudonymization is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.
g) Controller or processor
The controller or processor is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are laid down by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
h) Processor
A processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
i) Recipient
A recipient is a natural or legal person, public authority, agency, or another body to which personal data are disclosed, whether a third party or not. However, public authorities that may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.
j) Third party
A third party is a natural or legal person, public authority, agency, or other body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
k) Consent
Consent is any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

4. Collection of general data and information
The TERRANUS GmbH website collects a range of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server log files. The following may be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrer), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) other similar data and information that serves to avert danger in the event of attacks on our information technology systems.
When using this general data and information, TERRANUS GmbH does not draw any conclusions about the data subject. Rather, this information is required in order to (1) deliver the content of our website correctly, (2) optimize the content of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. 5. Subscription to our newsletter
On the TERRANUS GmbH website, users are given the opportunity to subscribe to our company’s newsletter. The personal data transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.
TERRANUS GmbH informs its customers and business partners at regular intervals by means of a newsletter about facts and trends relating to social real estate and the company’s offers. The data subject can only receive our company’s newsletter if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter. For legal reasons, a confirmation email is sent to the email address entered by a data subject for the first time for the newsletter dispatch using the double opt-in procedure. This confirmation email serves to verify that the owner of the email address has authorized the receipt of the newsletter as the data subject.
When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) to the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to be able to trace any (possible) misuse of the email address of a data subject at a later date and therefore serves to provide legal protection for the controller.
The personal data collected in the context of a newsletter subscription is used exclusively for the purpose of sending our newsletter. Furthermore, subscribers to the newsletter may be informed by email if this is necessary for the operation of the newsletter service or for a related registration, as may be the case in the event of changes to the newsletter offer or changes to the technical conditions. 6. Mailchimp
This website uses the services of Mailchimp to send newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.
Mailchimp is a service that can be used, among other things, to organize the sending of newsletters. When you enter data for the purpose of receiving the newsletter (e.g., email address), this data is stored on Mailchimp’s servers in the USA.

Data processing is based on your consent (Art. 6 (1) (a) GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.
The data you provide us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe. Data stored by us for other purposes remains unaffected.

After you unsubscribe from the newsletter distribution list, your email address will be stored by us or the newsletter service provider in a blacklist, if necessary, in order to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interests and our interests in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) (f) GDPR). There is no time limit for storage in the blacklist. You can object to the storage if your interests outweigh our legitimate interest.

7. Newsletter tracking
The newsletters from TERRANUS GmbH contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in emails sent in HTML format to enable log file recording and analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Using the embedded tracking pixel, TERRANUS GmbH can recognize whether and when an email was opened by a data subject and which links in the email were accessed by the data subject.
Such personal data collected via the tracking pixels contained in the newsletters is stored and evaluated by the controller in order to optimize the newsletter dispatch and to better tailor the content of future newsletters to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled to revoke their separate declaration of consent given via the double opt-in procedure at any time. After revocation, this personal data will be deleted by the controller. TERRANUS GmbH automatically interprets unsubscribing from the newsletter as revocation.
8. Contact option via the website
Due to legal requirements, the TERRANUS GmbH website contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (e-mail address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the controller is stored for the purpose of processing or contacting the data subject. This personal data is not passed on to third parties.
9. Routine deletion and blocking of personal data
The controller processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage or if this has been provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.
If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.
10. Rights of the data subject
a) Right to confirmation
Every data subject has the right granted by the European Directive and Regulation to request confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they may contact an employee of the controller at any time.
b) Right to information
Any person affected by the processing of personal data has the right, granted by European directives and regulations, to obtain information from the controller at any time, free of charge, about the personal data stored about them and a copy of this information. Furthermore, European directives and regulations grant the data subject the right to obtain the following information:
- the purposes of the processing
- the categories of personal data being processed
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
- where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
- the existence of a right to rectification or erasure of personal data concerning them or to restriction of processing by the controller or a right to object to such processing
- the existence of a right to lodge a complaint with a supervisory authority
- where the personal data are not collected from the data subject: All available information on the origin of the data
- the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject
Furthermore, the data subject has the right to obtain information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer.

c) Right to rectification
Any data subject affected by the processing of personal data has the right granted by the European legislator to obtain the rectification of inaccurate personal data concerning them without undue delay. Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary statement.
If a data subject wishes to exercise this right of rectification, they may contact an employee of the controller at any time.
d) Right to erasure (right to be forgotten)
Any person affected by the processing of personal data has the right granted by the European legislator to request that the controller erase personal data concerning them without delay, provided that one of the following reasons applies and insofar as the processing is not necessary:
- The personal data has been collected or otherwise processed for purposes for which it is no longer necessary.
- The data subject withdraws consent on which the processing is based in accordance with Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR, and there is no other legal basis for the processing.
- The data subject objects to the processing pursuant to Art. 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21(2) GDPR.
- The personal data has been processed unlawfully.
- The erasure of the personal data is necessary for compliance with a legal obligation in Union or Member State law to which the controller is subject.
- The personal data has been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.
If one of the above reasons applies and a data subject wishes to have personal data stored by TERRANUS GmbH deleted, they may contact an employee of the controller at any time. The TERRANUS GmbH employee will ensure that the request for deletion is complied with immediately.
If the personal data has been made public by TERRANUS GmbH and our company is obliged to delete the personal data as the controller pursuant to Art. 17 (1) GDPR, TERRANUS GmbH shall take appropriate measures, including technical measures, taking into account the available technology and implementation costs, to inform other controllers who process the published personal data that the data subject has requested these other data controllers to delete all links to this personal data or copies or replications of this personal data, unless processing is necessary. The employee of TERRANUS GmbH will take the necessary steps in each individual case.
e) Right to restriction of processing
Any person affected by the processing of personal data has the right granted by the European legislator to request the controller to restrict processing if one of the following conditions is met:
- The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
- The processing is unlawful, the data subject refuses to have the personal data deleted and instead requests the restriction of the use of the personal data.
- The controller no longer needs the personal data for the purposes of the processing, but the data subject needs it to assert, exercise or defend legal claims.
- The data subject has objected to the processing pursuant to Art. 21 (1) GDPR and it is not yet clear whether the legitimate reasons of the controller outweigh those of the data subject.
If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by TERRANUS GmbH, they may contact an employee of the controller at any time. The TERRANUS GmbH employee will arrange for the restriction of processing.
f) Right to data portability
Any data subject affected by the processing of personal data has the right, granted by the European legislator, to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Art. 6 (1) (a) GDPR or Art. Furthermore, when exercising their right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to obtain the transfer of the personal data directly from one controller to another controller.
Furthermore, when exercising their right to data portability pursuant to Art. 20 (1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another controller, insofar as this is technically feasible and does not adversely affect the rights and freedoms of others.
To assert the right to data portability, the data subject may contact an employee of TERRANUS GmbH at any time.
g) Right to object
Any person affected by the processing of personal data has the right granted by the European legislator to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them which is carried out on the basis of Article 6(1)(e) or (f) of the GDPR. This also applies to profiling based on these provisions.
In the event of an objection, TERRANUS GmbH will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing serves to assert, exercise, or defend legal claims.
If TERRANUS GmbH processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for such marketing purposes. This also applies to profiling insofar as it is related to such direct marketing. If the data subject objects to TERRANUS GmbH processing their data for direct marketing purposes, TERRANUS GmbH will no longer process the personal data for these purposes.

h) Automated individual decision-making, including profiling
Any person affected by the processing of personal data has the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, unless the decision (1) is not necessary for entering into, or performance of, a contract between the data subject and the controller, or (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is based on the data subject’s explicit consent.
If the decision (1) is necessary for entering into, or performance of, a contract between the data subject and the controller, or (2) is based on the explicit consent of the data subject, TERRANUS GmbH shall implement appropriate measures to safeguard the data subject’s rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express their point of view and to contest the decision.

i) Right to withdraw consent under data protection law
Every person affected by the processing of personal data has the right, granted by the European legislator, to withdraw consent to the processing of personal data at any time.

11. Data protection in job applications and the application process
The controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing may also be carried out electronically. This is particularly the case if an applicant submits the relevant application documents to the controller by electronic means, for example by email or via a web form on the website. If the controller concludes an employment contract with an applicant, the data transmitted will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller prevent deletion. Other legitimate interests in this sense include, for example, the burden of proof in proceedings under the General Equal Treatment Act (AGG).
12. Data protection provisions regarding the use of etracker
TERRANUS GmbH uses the services of etracker GmbH from Hamburg to analyze usage data. By default, no cookies are used for web analysis. If analysis and optimization cookies are used, your explicit consent will be obtained separately in advance. If this is the case and you agree, cookies will be used to enable statistical reach analysis of this website, measurement of the success of online marketing measures, and testing procedures, e.g., to test and optimize different versions of the online offering or its components. Cookies are small text files that are stored by the Internet browser on the user’s device. etracker cookies do not contain any information that enables a user to be identified.
The data generated with etracker is processed and stored exclusively in Germany on behalf of TERRANUS GmbH by etracker and is therefore subject to strict German and European data protection laws and standards. etracker has been independently tested and certified in this regard and has been awarded the data protection seal of approval.
Data processing is carried out on the basis of the legal provisions of Art. 6 (1) lit. f (legitimate interest) of the General Data Protection Regulation (GDPR). The purpose within the meaning of the GDPR (legitimate interest) is to optimize the online offering and website. As TERRANUS GmbH values the privacy of its visitors, data that may be related to an individual, such as IP addresses, login or device identifiers, is anonymized or pseudonymized as soon as possible. 13. Leadinfo
We have integrated Leadinfo into this website. The provider is Leadinfo / Team.Blue GmbH, Bunsenstr. 19, 40215 Düsseldorf (hereinafter “Leadinfo”).
Leadinfo enables us to record visits to our website by employees of other companies. For this purpose, the IP address of the website visitor is compared with the company IP addresses stored in Leadinfo’s company database. If the IP address belongs to a company, the visit and user behavior are recorded. IP addresses that are not present in Leadinfo’s database are immediately deleted, so that website visits by private individuals are ignored by Leadinfo.

14. Note on data transfer to the USA and other third countries
Among other things, we use tools from companies based in the USA or other third countries that do not have secure data protection laws. We would like to point out that these countries cannot guarantee a level of data protection comparable to that of the EU. 15. Legal basis for processing
Art. 6 I lit. a GDPR serves as the legal basis for our company for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations necessary for the delivery of goods or the provision of other services or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the performance of our business activities for the benefit of all our employees and our shareholders. We also collect and process data to optimize our website and our services.
18. Duration for which the personal data is stored
The criterion for the duration of the storage of personal data is the respective statutory retention period. After expiry of this period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfillment of the contract or for the initiation of a contract.
